NURSING HOME VICTIMS

Recent Case: Our law firm assisted a retired school teacher who was confined to a wheel chair and resided in a nursing home due to lack of mobility. The nursing home's Care Plan required a minimum of two people to assist our client with all transfers from her wheel chair to her bed. Only one attendant was assisting her when she fell and broke her leg. The result was a compound fracture that required extensive surgery and rehabilitation.

Result: Case was settled for $200,000.

Recent Case: An elderly man, father of three sons, wandered away from the nursing home where he was residing in an attempt to return to the nursing home he had previously resided in, located a few NUndred feet away. The alarm system at the nursing home was not working. The man became disoriented and did not return to either nursing home. It was winter and very cold outside. The man was found the following day, face down in a creek bed. He had died through the night from exposure to the cold weather.

Result: Case was settled for $310,000.

PERSONAL INJURY

Recent Case: Our client, a middle aged lady, was rear ended by a negligent driver while she was stopped at an intersection. Our client sustained bruises, lacerations, contusions and nerve damage to her facial area, nose and eyes, a left orbital fracture and loss of a complete range of vision, in addition to neck pain, bilateral jaw pain, back pain and bruises and contusions to her right arm.

Result: The case was settled for $180,000.00.

Recent Case: A gentleman was mistakenly castrated when a doctor removed his only remaining testicle during a routine hernia surgery. Due to the medical negligence the man was forced to begin a lifetime of hormone therapy and other treatment.

Result: Confidential Settlement.

Recent Case: An elderly woman was knocked to the ground while entering a grocery store when the automatic door malfunctioned. The result was a broken hip. We asserted claims against both the grocery store and the automatic door company.

Result: The case was settled for $150,000.00.

Recent Case: A 54 year old lady entered a grocery store and slipped on a wet surface of the floor near a soda pop display.  We discovered that earlier that morning an employee was building a display of product with a forklift when the forklift lunged forward and fell over on to its front forks, spilling the full pallet load of product on to the floor, causing numerous cans of product to break open and spill onto the floor.  The forklift also leaked fluids onto the floor.  The store placed no warning signs or barricades around the area of the spill at anytime. As a result of the fall, the lady suffered injuries to her skull, her cervical and lumbar spine, her left hip, her shoulders, and her left knee.  The injuries included a concussion, cervical sprain, lumbar strain, left hip contusion and bruising and a tear of the anterior horn of the meniscus in her left knee.  She underwent extensive treatment and physical therapy, including arthrosporic surgery on her left knee.  She was also financially devastated because she was no longer able to work.

Result: Case was settled for $200,000.


WRONGFUL DEATH

Recent Case: An eleven year old female who had just completed the fifth grade was waiting for her mother to pick her and a friend up from a neighborhood swimming pool located in a public park. The girl and her friend walked to a new playground area located in the park which was directly adjacent to the swimming pool. As the girl approached the playground area, she stepped next to a light pole and rolled metal fencing that was located near the new playground area. When she came in contact with the light pole and rolled metal fencing, a current of electricity entered her body which caused her death. It was determined that the light pole contained 103 volts of electricity and that the rolled fencing and standing fence also had an electrical current running through them. We also discovered that the lighting system had been installed improperly, contained inadequate gauge and improper type of wire, the lighting system contained improper sizes and types of fuses, did not contain a grounding rod at the base of each pole or a grounding rod for the panel box and the lighting system was not properly grounded. Subsequent tests of the light pole revealed that there was a short circuit in one of the 240 volt light fixtures attached to the light pole which caused the light pole to contain an ungrounded electrical current and to become energized. The light fixture and pole at issue had earlier been repaired by the Defendants.

Result: Case was settled for $881,000.

Recent Case: A first grade girl, an only child, was exiting her school bus at a four-way intersection in a rural town. Her mother had a beauty shop a block away from the bus stop where the girl always went after school. After exiting the school bus, the girl crossed the street in the crosswalk as she had always done and was run over by her school bus that had negligently begun a right turn through the crosswalk.

Result: The case was settled for $375,000.00 and a number of new school bus safety measures were enacted to assure the safety of school children as a result of this case. The parents established a scholarship in the name of their deceased daughter with a portion of the settlement funds.


CONSTRUCTION LAW

Recent Case: Our client was a subcontractor on construction of the EPA building in Kansas City, Kansas. When the project was completed, the general contractor brought a claim against our client for $750,000.00 and we asserted a counterclaim.

Result: We defeated the contractor's claim and recovered over $400,000.00 for our client.

Recent Case: We represented an excavator subcontractor regarding a construction project in Warrensburg, Missouri. When the general contractor and owners of the property failed to pay our client, we asserted claims against the general contractor and owners, including mechanic's lien claims. The general contractor asserted counterclaims.

Result: The case was tried to the court and we obtained a judgment against the general contractor and the owners on all of our client's claims, including the mechanic's lien claim, for over $220,000.00, plus interest, attorney's fees and costs.

BUSINESS LITIGATION

Recent Case: A bank sued our corporate client for several thousand dollars. We discovered that the bank had actually misled our client and filed counterclaims against the bank for failing to disclose certain pertinent information.

Result: Case settled with the bank paying our client $125,000.

Recent Case: Our client was not by paid by a grocery store chain for work our client had provided. The grocery store chain then filed bankruptcy. The value of our client's unsecured claim was in excess of $500,000.00. We asserted claims in the bankruptcy, including mechanic's lien claims.
